About the role
Responsibilities
- Manage a volume of complex surety (bond claims), trade credit (subrogation), and recovery files using risk-based prioritization.
- Analyze and structure matters involving securities (PPSA, movable hypothecs, assignment of receivables), secured creditors, and priority disputes.
- Represent the company before all levels of court, administrative tribunals, mediation, and arbitration.
- Intervene in insolvency, restructuring, or arrangement proceedings (CCAA/BIA) by interfacing with trustees and financial institutions.
- Advise underwriting teams on preliminary legal analysis for indemnity agreements, performance bonds, and guarantees.
- Provide legal opinions to claims teams regarding liability, subrogation, and recovery strategies.
- Lead multi-party negotiations with clients, financial institutions, and third parties to achieve favorable outcomes.
- Contribute to the development of standard legal forms and deliver internal training to underwriting and claims teams.
Requirements
- Bachelor of Laws (LL.B. or J.D.) and membership in good standing with the Law Society of Ontario.
- 10+ years of relevant legal experience.
- Expertise in complex civil litigation, specifically in surety law, trade credit, securities, and recovery.
- Strong knowledge of securities law (PPSA), insolvency (CCAA/BIA), and commercial contract law.
- Proven ability in drafting, research, negotiation, and all stages of litigation including trial.
- Willingness to travel across Ontario and Canada occasionally as needed.
Preferred Qualifications
- Experience with Ontario’s Construction Act (construction liens and bonds).
- Membership in a bar of one of the Atlantic provinces.
- Bilingualism (English and French).
- Experience mentoring less experienced legal professionals.
