Director/Senior Director, Commercial Counsel

Responsibilities

• Serve as brand attorney and legal business partner for the Commercial department, including Marketing, Sales, and Market Access
• Counsel on communications regarding products and relationships with healthcare professionals, patients, and payors
• Participate in medical, legal, and regulatory review committees for promotional and medical materials
• Support Market Access team with strategic legal counseling and contract review
• Support the planning and execution of pre-launch and launch activities
• Review and negotiate a wide range of commercial agreements
• Monitor new laws, regulations, and industry trends to assist in policy and training development

Requirements

• JD from an accredited law school
• Admission to the New York Bar or ability to obtain admission
• 6-8+ years of legal experience in the pharmaceutical industry (law firm or in-house)
• Ability to work on-site in New York City at least three days per week (Monday, Tuesday, and Thursday)

Preferred Qualifications

• Prior experience advising on pharmaceutical advertising and promotional matters
• Experience participating in promotional and medical review processes
• Strong knowledge of FDA regulations, False Claims Act, Anti-Kickback Statute, OIG guidance, and PhRMA Code
• Knowledge of state and federal data privacy laws and product liability laws
• Experience supporting market access teams
